Consumer \u2013 a natural person concluding a contract with the Seller within the Store,<br \/>whose subject matter is not directly related to its business activity or<br \/>professional.<br \/>2. Seller \u2013 a natural person running a business under a company name<br \/>SARNETSKI Szymon Sarnecki, Siciny 36, 52-215 Niechl\u00f3w, NIP: 501-007-85-90.<br \/>2. Customer \u2013 any entity making purchases via the Store.<br \/>3. Entrepreneur \u2013 a natural person, a legal person and an organizational unit other than one<br \/>a legal person to whom a separate act grants legal capacity, exercising legal capacity<br \/>a business using the Store on its own behalf.<br \/>4. Store \u2013 online store run by the Seller at the Internet address<br \/>www.wp-plugin.store<\/p><p>5. Distance contract &#8211; contract concluded with the Customer under<br \/>organized system for concluding distance contracts (within the Store), without<br \/>simultaneous physical presence of the parties, with the exclusive use of one or<br \/>more means of distance communication until the conclusion of the contract<br \/>inclusive.<br \/>6. Regulations &#8211; these regulations of the Store.<br \/>7. Shopping cart \u2013 an element of the Store&#8217;s software in which the selected products are displayed<br \/>Customer Products for purchase, and it is also possible to determine and modify data<br \/>Orders, in particular product quantities.<br \/>12. Product \u2013 a movable item\/service available in the Store that is the subject of the Agreement<br \/>Sales between the Customer and the Seller.<br \/>13. Sales Agreement &#8211; a Product sales agreement concluded or concluded between<br \/>the Customer and the Seller via the Online Store. The Customer may communicate with the Seller by phone between 10:00 a.m. and 4:00 p.m. on business days.<\/p><p>\u00a0<\/p><p><strong>\u00a74\u00a0Technical requirements<\/strong><\/p><p><br \/>To use the Store, including browsing the Store&#8217;s assortment and placing orders<br \/>orders for Products, it is necessary:<br \/>a. end device with access to the Internet and a web browser<br \/>Google Chrome, Mozilla, etc.,<br \/>b. active e-mail account,<br \/>c. cookie support enabled,<br \/>d. FlashPlayer installed.<\/p><p>\u00a0<\/p><p><strong>\u00a75\u00a0General information<\/strong><\/p><p><br \/>1. The Seller shall not be liable to the fullest extent permitted by law<br \/>liability for disruptions, including interruptions in the operation of the Store<br \/>caused by force majeure, unauthorized action of third parties or<br \/>incompatibility of the Online Store with the Customer&#8217;s technical infrastructure.<br \/>2. Browsing the Store&#8217;s assortment does not require creating an Account. Folding<br \/>orders by the Customer for Products included in the Store&#8217;s assortment is possible<br \/>either after creating an Account in accordance with the provisions of \u00a7 6 of the Regulations or by providing<br \/>necessary personal and address data enabling the execution of the Order<br \/>without creating an Account.<br \/>3. The prices given in the Store are given in Polish zlotys and are gross prices.<br \/>4. The final (final) amount to be paid by the Customer consists of the price for the Product<br \/>and the cost of delivery (including transportation, delivery\u00a0and postal service charges) at which time<br \/>The Customer is informed on the Store&#8217;s website when placing the Order, including:<br \/>also at the time of expressing the will to be bound by the Sales Agreement.<br \/>5. To create an Account in the Store, complete the Registration Form. It is essential<br \/>providing the following data: name and surname, e-mail address, residential address.<\/p><p>2. Creating an Account in the Store is free.<br \/>3. Logging in to the Account is done by entering your login (email) and password<br \/>established in the Registration Form.<br \/>4. The customer has the option at any time, without giving a reason and without incurring any costs<br \/>due to any fees, delete the Account by sending an appropriate request to<br \/>Sellers, in particular via e-mail or in writing to<br \/>addresses provided in \u00a7 3.<\/p><p>\u00a0<\/p><p><strong>\u00a77\u00a0Rules for placing an Order<\/strong><\/p><p><br \/>To place an Order you must:<br \/>1. log in to the Store (optional);<br \/>2. select the Product that is the subject of the Order, and then click the &#8222;To&#8221; button<br \/>basket&#8221; (or equivalent);<br \/>3. log in or use the option of placing an order without registration;<br \/>4. if you have chosen to place an Order without registration \u2013 complete the Form<br \/>order by entering the details of the recipient of the Order and his address<br \/>the Product will be delivered, select the type of shipment (method of Product delivery),<br \/>enter the invoice details if they are different from the details of the recipient of the Order,<br \/>5. click the &#8222;Order and pay&#8221; button\/click the &#8222;Order and pay&#8221; button and\/or<br \/>confirm the order by clicking on the link sent in the e-mail,<br \/>6. select one of the available payment methods and depending on the payment method,<br \/>pay for the order within the specified period, subject to \u00a7 8 point 3.<\/p><p><br \/><strong>\u00a78\u00a0Delivery and payment methods offered<\/strong><\/p><p><br \/>1. The customer can use the following methods of delivery\u00a0or collection of the order<br \/>Product:<br \/>a. Electronic delivery (email)<br \/>2. The customer can use the following payment methods:<\/p><p>a.\u00a0PayNow payments<\/p><p>b. BLIK payment<\/p><p>c. Details of delivery methods and\u00a0acceptable methods<br \/>payments are available on the Store&#8217;s website.<\/p><p>\u00a0<\/p><p><strong>\u00a79\u00a0Execution of the sales contract<\/strong><\/p><p><br \/>1. The Sales Agreement between the Customer and the Seller is concluded after prior notice<br \/>the Customer places an Order using the Order Form in the Store<br \/>online in accordance with \u00a7 7 of the Regulations.<br \/>2. After placing the Order, the Seller immediately confirms its receipt and<br \/>at the same time accepts the Order for execution. Delivery confirmation<br \/>The order and its acceptance for execution take place by sending via<br \/>The Seller will send the Customer an appropriate e-mail message to the address provided during submission<br \/>Orders the Customer&#8217;s e-mail address, which contains at least<br \/>the Seller&#8217;s declaration of receipt of the Order and its acceptance for execution, and<br \/>confirmation of conclusion of the Sales Agreement. Upon receipt by the Customer<br \/>the above e-mail message, a Sales Agreement is concluded between the Customer and<br \/>Seller.<br \/>3. If the Customer chooses:<br \/>a. PayNow payments, BLIK payments or payment card payments, Customer<br \/>is obliged to make the payment within 24 hours from the date<br \/>conclusion of the Sales Agreement &#8211; otherwise the order will be canceled.<br \/>4. If the Customer has chosen a delivery method other than electronic mail, the Product will remain<br \/>sent by the Seller within the time specified in its description (subject to<br \/>paragraph 5 of this paragraph), in the manner chosen by the Customer when submitting<br \/>Orders.<br \/>5. A If you order Products with different delivery dates, the deadline<br \/>delivery is the longest given date.<br \/>B In the event that Products are ordered with different delivery dates, the Customer has<br \/>the possibility of requesting delivery of the Products in parts or all of them<br \/>Products after completing the entire order.<br \/>6. Product delivery costs (including transport, delivery and service fees<br \/>postal) are indicated to the Customer on the Online Store&#8217;s website in the tab<br \/>&#8222;Delivery and payment&#8221; and when placing an Order, including at<br \/>the Customer&#8217;s will to be bound by the Sales Agreement.<\/p><p>\u00a0<\/p><p><strong>\u00a710\u00a0Right to withdraw from the contract<\/strong><\/p><p>\u00a0<\/p><p>1. The Consumer may withdraw from the Sales Agreement without giving any notice within 14 days<br \/>any reason.<br \/>2. The period specified in section 1 begins with the delivery of the Product<br \/>The consumer or a person designated by him other than the carrier.<br \/>3. In the case of an Agreement that covers multiple Products that are delivered separately,<br \/>in batches or parts, the deadline specified in section 1runs from the delivery of the last item,<br \/>batch or part.<br \/>4. In the case of a Contract that involves the regular delivery of Products over time<br \/>marked (subscription), the deadline specified in section 1 runs from taking possession<br \/>the first thing.<br \/>5. The Consumer may withdraw from the Agreement by submitting a declaration to the Seller<br \/>withdrawal from the Agreement. This is enough to meet the deadline for withdrawing from the Agreement<br \/>sending the declaration by the Consumer before the expiry of this deadline.<br \/>5.1 The declaration may be sent by traditional post by sending it<br \/>declarations to the Seller&#8217;s address &#8211; the Seller&#8217;s contact details have been specified<br \/>in \u00a7 3. The declaration may also be submitted on the form, the template of which is<br \/>Annex No. 1 to these Regulations and Annex to the Act of May 30, 2014<br \/>year on consumer rights, but this is not obligatory.<br \/>6. Effects of withdrawal from the Agreement:<br \/>a. In the event of withdrawal from an Agreement concluded remotely, the Agreement shall be deemed to have been concluded<br \/>not included.<br \/>b. In the event of withdrawal from the Agreement, the Seller returns the goods to the Consumer<br \/>immediately, no later than 14 days from the date of receipt of the declaration<br \/>the Consumer to withdraw from the Agreement, all payments made by him, incl<br \/>including the costs of delivering the goods, with the exception of additional costs arising from<br \/>a delivery method chosen by the Consumer other than the cheapest ordinary one<br \/>delivery method offered by the Seller.<br \/>c. The Seller will refund the payment using the same payment methods,<br \/>that were used by the Consumer in the original transaction, unless the Consumer<br \/>he has expressly agreed to an alternative solution that will not\u00a0involve him<br \/>at no cost.<br \/>d. The Seller may withhold the refund until receipt<br \/>the product back or until you provide him with proof of its return, in<br \/>depending on which event occurs first.<br \/>e. The Consumer should return the Product to the Seller&#8217;s address provided herein<br \/>Regulations immediately, no later than 14 days from the date on which he informed<br \/>Seller to withdraw from the Agreement. The deadline will be met if the Consumer<br \/>will send back the Product before the 14-day period expires.<br \/>f. The consumer bears the direct costs of returning the Product, including return costs<br \/>Product if, due to its nature, this Product could not be left in the usual<br \/>sent by mail mode.<br \/>g. The Consumer is only responsible for the reduction in the value of the Product resulting from<br \/>using it in a way other than what was necessary to establish the nature,<br \/>features and functioning of the Product.<br \/>9. If, due to the nature of the Product, it cannot be returned<br \/>by regular mail, information about this, as well as the costs of returning the Product, will be sent<br \/>be found in the Product description in the Store.<br \/>10. There is no right to withdraw from a distance contract<br \/>To the Consumer in relation to the Agreement:<br \/>a. in which the subject of the service is a non-prefabricated, manufactured item<br \/>according to the Consumer&#8217;s specifications or to satisfy his\/her individual needs<br \/>needs,<br \/>b. in which the subject of the service is an item delivered sealed<br \/>packaging which cannot be returned for protection reasons once the packaging has been opened<br \/>health or hygiene reasons if the packaging has been opened after<br \/>delivery,<br \/>c. for the provision of services, if the Seller has fully performed the service with express consent<br \/>A consumer who has been informed before the commencement of the service that after<br \/>after the Seller has completed the service, he will lose the right to withdraw from the Agreement,<br \/>d. in which the price or remuneration depends on fluctuations in the financial market over which<br \/>The Seller has no control, and which may occur\u00a0before the deadline by<br \/>withdrawal from the Agreement,<br \/>e. in which the subject of the service are items that, after delivery, due to<br \/>their character, become inextricably linked with other things,<br \/>f. in which the subject of the service are alcoholic beverages, the price of which has been determined<br \/>agreed upon concluding the sales contract, and which may be delivered<br \/>only after 30 days and whose value depends\u00a0on market fluctuations over which they are controlled<br \/>The seller has no control<br \/>g. in which the subject of the service are sound or visual recordings or<br \/>computer programs delivered in a sealed\u00a0package, if<br \/>the packaging was opened after delivery,<br \/>h. for the delivery of newspapers, periodicals or magazines, except for the contract for<br \/>subscription,<br \/>i. for the supply of digital content that is not recorded on a tangible medium, if<br \/>performance began with the express consent of the Consumer before expiry<br \/>deadline for withdrawal from the contract and after the Seller informs him about the loss<br \/>the right to withdraw from the Agreement,<\/p><p>\u00a0<\/p><\/div><p><strong>\u00a711 Complaint and warranty<\/strong><\/p><p><br \/>1.1 The Sales Agreement covers new Products.<br \/>1.2. Complaints should be submitted in writing or electronically to the address provided below<br \/>these Regulations, the Seller&#8217;s addresses or using electronic means<br \/>complaint form provided by the Seller on one of the subpages<br \/>Store.<br \/>2. It is recommended that the complaint include, among others: a concise description of the defect, circumstances (incl<br \/>date) of its occurrence, data of the Customer submitting the complaint, and the Customer&#8217;s request<br \/>due to a defect in the goods.<br \/>The Seller will respond to the complaint request immediately, no later than<br \/>within 14 days, and if it does not do so within this period, it is considered that the Customer&#8217;s request has been accepted<br \/>considered justified.<br \/>Goods returned under the complaints procedure should be sent to the address provided in<br \/>\u00a7 3 of these Regulations.<br \/>If a warranty has been granted for the Product, information about it and its<br \/>content will be included in the Product description in the Store.<\/p><p>\u00a0<\/p><p><strong>\u00a712 Extrajudicial methods of dealing with complaints and pursuing claims<\/strong><\/p><p><br \/>1. Detailed information regarding the Consumer&#8217;s ability to use<br \/>extrajudicial methods of dealing with complaints and pursuing claims, and<br \/>the rules for access to these procedures are available at the offices and on the websites<br \/>online district (municipal) consumer ombudsmen, organizations<br \/>social, whose statutory tasks include consumer protection,<br \/>Provincial Inspectorates of the Trade Inspection and at the following addresses<br \/>websites of the Office of Competition and Consumer Protection:<br \/>http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php;<br \/>http:\/\/www.uokik.gov.pl\/sprawy_zdrowie.php and<br \/>http:\/\/www.uokik.gov.pl\/wazne_adresy.php.<br \/>2. The consumer has the following sample options to use:<br \/>extrajudicial methods of dealing with complaints and pursuing claims:<br \/>a. The consumer is entitled to apply to a permanent arbitration court<br \/>consumer, referred to in Art. 37 of the Act of 15 December 2000 on Inspection<br \/>Handlowa (Journal of Laws of 2014, item 148, as amended), with a request to resolve the dispute<br \/>arising from the Agreement concluded with the Seller.<br \/>b. The consumer is entitled to contact the provincial inspector of inspection<br \/>Commercial, in accordance with Art. 36 of the Act of 15 December 2000 on Trade Inspection<br \/>(Journal of Laws of 2014, item 148, as amended), with a request to initiate proceedings<br \/>mediation regarding the amicable settlement of the dispute between the Consumer and<br \/>Seller.<br \/>c. The consumer can obtain free assistance in resolving the dispute between<br \/>him and the Seller, also using the free assistance of the district (municipal)<br \/>consumer ombudsman or social organization whose statutory tasks include<br \/>consumer protection (including Consumer Federation, Consumer Association<br \/>Polish).<\/p><p>\u00a0<\/p><\/div><p><strong>\u00a713 Personal data in the Online Store<\/strong><\/p><p>\u00a0<\/p><p>The administrator of Customers&#8217; personal data collected via the Store<br \/>the online store is the Seller.<br \/>1. Detailed information regarding the processing of personal data by<br \/>the seller &#8211; including other purposes and basis for data processing, a<br \/>also about data recipients &#8211; can be found in the Privacy Policy available in the Store &#8211;<br \/>due to the principle of transparency contained in Parliament&#8217;s general regulation<br \/>European and Council (EU) on the protection of personal data &#8211; &#8222;GDPR&#8221;.<br \/>2. Customers&#8217; personal data collected by the administrator via the Store<br \/>online are collected for the purpose of implementing the Sales Agreement, and if the Customer consents to<br \/>is consent &#8211; also for marketing purposes.<br \/>The basis for the processing of personal data in this case is: sales contract<br \/>or actions taken at the request of the Buyer, aimed at concluding the contract (Article 6<br \/>paragraph 1 letter b GDPR), the Seller&#8217;s legal obligation related to<br \/>accounting (Article 6(1)(c)) and the legally justified interest of the Seller,<br \/>involving the processing of data for the purpose of establishing, investigating or defending<br \/>possible claims (Article 6(1)(f) of the GDPR).<br \/>3. The recipients of personal data of Online Store Customers may be:<br \/>a. In the case of a Customer who uses the delivery method in the Online Store<br \/>by post or courier, the Administrator provides the collected data<br \/>the Customer&#8217;s personal data to the selected carrier or intermediary carrying out the shipment<br \/>at the request of the Administrator.<br \/>b. In the case of a Customer who uses a payment method in the Online Store<br \/>electronically or by payment card. The Administrator provides the collected personal data<br \/>the Customer, the selected entity handling the above-mentioned payments in the Store<br \/>online.<\/p><p>4. The customer has the right to access and correct his data.<br \/>5. Providing personal data is voluntary, although not providing the data indicated in<br \/>The Regulations on personal data necessary to conclude the Sales Agreement apply<br \/>impossibility of concluding this contract.<\/p><p><br \/><strong>\u00a714 Final provisions<\/strong><\/p><p><br \/>Contracts concluded via the Online Store are concluded in Polish.<br \/>2. The Seller reserves the right to make changes to the Regulations from time to time<br \/>the reasons are: changes in legal regulations, changes in payment and delivery methods &#8211; incl<br \/>to the extent that these changes affect the implementation of the provisions of this<br \/>Regulations. The Seller will inform the Customer about each change at least on the 7th day<br \/>days in advance.<br \/>3. Matters not regulated in these Regulations shall apply<br \/>generally applicable provisions of Polish law, in particular: the Code<br \/>civil; Act on the provision of electronic services; Act on rights<br \/>consumer, Personal Data Protection Act.<br \/>4. The customer has the right to use extrajudicial methods of dealing with complaints<br \/>pursuing claims.
